General Terms and Conditions of Sale and Use of Nouba Plus Websites and Application

Preamble

The website https://noubaplus.com/ and its associated applications (hereinafter referred to as "the Platform") represent a digital online flight booking platform. The Platform is operated in Algeria in accordance with current e-commerce regulations.

The Platform is the exclusive property of Nouba Plus.

Use of the platform, registration, or any purchase made on the Platform constitutes full, complete, and unreserved acceptance of these terms and conditions by the user (hereinafter "the Customer" or "the Buyer").

Article 1: Purpose and scope

These General Terms and Conditions of Sale and Use (GTC/GTU) detail the rights and obligations of Nouba Plus and its Customers regarding the sale of air transport tickets. Any transaction on the platform implies prior consultation and adherence to these conditions as well as the privacy policy.

Article 2: Eligibility and user obligations

By accessing the Platform, the user declares to be at least 18 years of age and to possess full legal capacity. The user undertakes to:

  • Provide strictly accurate information during booking (names matching the passport).
  • Not use the platform for fraudulent or speculative bookings.
  • Acknowledge that any entry error is their sole responsibility.

Article 3: Intellectual property

The name "Nouba Plus," logos, graphic interfaces, and software content are the intellectual property of Nouba Plus. No data from the site may be reproduced, modified, or commercially exploited without the prior written authorization of Nouba Plus.

Article 4: Data privacy and security

Nouba Plus is committed to protecting the privacy of its users:

  • Hosting: In accordance with Algerian law, personal data is stored on secure servers.
  • Security: Payments are protected by the SSL (Secure Sockets Layer) protocol, ensuring that bank details are encrypted before transmission.
  • Sharing: Data is only transmitted to partners necessary for the execution of the service (airlines, payment services, or legal authorities).

Article 5: Booking and availability

Availability: Displayed flights and fares are synchronized with the airlines. The price is only guaranteed at the time of effective payment validation.

Limitation: A single booking file is limited to nine (09) passengers. Nouba Plus reserves the right to suspend any account demonstrating abusive use (excessive unpaid bookings).

Article 6: Payment terms

Prices are indicated in Algerian Dinars (DZD) and include all taxes. Accepted payment methods are:

  • Edahabia Card (Algérie Poste).
  • Interbank Card (CIB): The Customer must verify their online payment limit before purchase.
  • Cash on Delivery: This service is only applicable when this option is available and offered on the interface at the time of order. Final confirmation of the e-ticket occurs only after the full collection of funds by the authorized agent.

Article 7: Modification and cancellation

In accordance with air transport regulations, the standard right of withdrawal does not apply to airline tickets.

  • Airline Rules: Each ticket is subject to the airline's fare conditions (changeable, refundable, or non-refundable).
  • Service Fees: For any modification or refund management, Nouba Plus will apply additional administrative fees.

Article 8: Liability and travel documents

The passenger is solely responsible for obtaining the necessary travel documents (Passport, Visas, Health formalities). Nouba Plus cannot be held liable in the event of boarding refusal due to a passenger's documentary irregularity.

Article 9: Force majeure

Nouba Plus shall not be held liable if the performance of its obligations is delayed or prevented by a case of force majeure (natural disaster, pandemic, government decision, transport strike).

Article 10: Applicable law and disputes

These GTC are governed by Algerian Law. Any dispute relating to their interpretation or execution shall, in the absence of an amicable agreement, be brought before the competent Algerian courts within the jurisdiction of Nouba Plus's registered office.
